Tax Increment Financing Commission

The Tax Increment Financing (TIF) Commission is a standing body created by the city to help review and guide redevelopment projects funded through tax increment financing. The commission has 11 members: 2 appointed by affected school districts, 1 representing other local taxing districts, and 8 appointed by the mayor with city council approval (7 city residents and 1 county resident). For projects under review, the school and taxing district representatives serve only until the city council makes a final decision on the project; after that, the commission generally continues with 6 city-appointed members, who serve 4-year terms going forward. The commission elects its own officers annually, meets regularly under its own adopted procedures, keeps records, reports yearly to the city council, and is authorized to exercise powers allowed under Missouri’s TIF law to evaluate and make recommendations on redevelopment plans. The commission meets as needed.

DIVISION 3. – TAX INCREMENT FINANCING COMMISSION
 
Sec. 2-235. – Created.
 

There is hereby created a commission to be known as the Tax Increment Financing Commission, which commission shall have continuous and perpetual existence unless and until terminated by action of the city council.

Sec. 2-236. – Membership.
 

(a) The Tax Increment Financing Commission shall be composed of eleven members to be appointed as follows:

(1) Two members shall be appointed by the school board whose district is included within the redevelopment plan or redevelopment area of each tax increment financing project. Such members shall be appointed in any manner agreed upon by the affected school district.

(2) One member shall be appointed in any manner agreed upon by the affected districts to represent all other districts levying ad valorem taxes within the area selected for a redevelopment project or the redevelopment area, excluding representatives of the city council.

(3) Seven members, citizens of the city, and one of the county, shall be appointed by the mayor with the consent of the majority of the city council.

(b) The terms of the members of the commission who are appointed by the school boards or other taxing districts shall coincide with the length of time a redevelopment project, redevelopment plan or designation of a redevelopment area, as defined in the Real Property Tax Increment Allocation Redevelopment Act, RSMo 99.800 et seq., is considered for approval by the commission. Such term shall terminate upon final approval of the project, plan or designation of the area by the city council. Thereafter, the commission shall consist of the six members appointed by the city, except that members representing school boards and other taxing districts shall be appointed as provided in the Real Property Tax Increment Allocation Redevelopment Act, RSMo 99.800 et seq., prior to any amendments to any redevelopment plans, redevelopment projects or designation of a redevelopment area. If any school district or other taxing jurisdiction fails to appoint members to the commission within 30 days of receipt of written notice of a proposed redevelopment plan, redevelopment project or designation of a redevelopment area, the remaining members may proceed to exercise the power of the commission. Of the members first appointed by the city, two shall be designated to serve for a term of two years, two shall be designated to serve for a term of three years and two shall be designated to serve for a term of four years from the date of such initial appointments. Thereafter, the members appointed by the city shall serve for a term of four years, except that all vacancies shall be filled for unexpired terms in the same manner as the original appointments.

Sec. 2-237. – Officers.
 

The Tax Increment Financing Commission shall organize itself and elect from its number a chairperson, vice-chairperson, treasurer and secretary, each to serve for one-year terms or until their successors are elected.

Sec. 2-238. – Meetings; rules of procedure.
 

The Tax Increment Financing Commission shall meet regularly and shall adopt such rules and regulations for operation as shall enable it to maintain an orderly procedure for its business and to effectively and efficiently exercise the powers authorized by the Real Property Tax Increment Allocation Redevelopment Act, RSMo 99.800 et seq. and delegated to it by the city council.

Sec. 2-239. – Records; reports.
 

The Tax Increment Financing Commission shall keep records and minutes of its meetings and shall report annually to the city council respecting its activities.

Sec. 2-240. – Powers.

The city council authorizes and approves the exercise by the Tax Increment Financing Commission of all the powers delegable under the Real Property Tax Increment Allocation Redevelopment Act, RSMo 99.800 et seq., and in particular those enumerated in RSMo 99.820(3) thereof.
